Use of the software provided with this agreement (the “software”) constitutes your acceptance of these terms. Read it carefully before completing the installation process and using the software. If you do not agree to the terms of this agreement, do not install and/or use this software. by installing, copying, or otherwise using the software product, you agree to be bound by the terms of this eula.
This agreement details the terms of use of the program provided by this website and other websites on internet, to you (hereby referred to as "You" and "Your") and may be modified and updated occasionally. By using,downloading AB Bulk Mailer or any other product of Software Research, from anywhere you agree that you have both read and understand the Terms and Conditions laid out in this agreement and accept that use of these softwares/services is a a signed and written legal contract. Terms that "You" are accepting are below:-
1. You accept that you will use the 'AB Bulk Mailer for startups/our other products of Software Research' for sending newsletter emails to subscribed people, strictly in conformity to laws of all countries.
2. You agree that I will not use it for any illegal activity like spamming, phishing, hacking , pornography, virus, vishing, cyber crime etc.
2. DO NOT SEND UNSOLICITED EMAIL. Be aware that you are solely responsible for the messages you send. In many cases sending unsolicited email (AKA Spam) is in violation of the law, and you will be solely accountable and liable for damages and violations. You legally agree that makers of the software are not responsible for any misuse of the software at your end for spam, hacking, phishing etc.
3. You will not copy or distrbute the software to third parties.
4.REVERSE ENGINEERING. You agree that you will not attempt to reverse compile, modify, translate, or disassemble the SOFTWARE provided by us, in whole or in part.
5. NO OTHER WARRANTIES. The software product is provided “as is” without warranty of any kind.
6.SEVERABILITY. In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.
7.NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall Software Research or its sister companies or suppliers are liable to you for any consequential, special, incidental or direct or indirect damages of any kind arising out of delivery, performance or use of the 'AB Bulk Mailer' software or any other software that was made by Software Research.
8. GOVERNING LAW. This agreement is governed by the laws of the India only and and for dispute resolution ,the place of arbitration shall be Srinagar J&K India and the arbitration proceedings shall be conducted in English language.”.
9. GENERAL PROVISION. This is the entire agreement between you and Software Research, which supersedes any prior agreement or understanding, whether written, or oral, relating to the subject matter of this license.
10. From time to time, We may revise this Agreement. We reserve the right to do so, and You agree
that Wehave this unilateral right. You agree that all modifications or changes to this Agreement
are in force and enforceable immediately upon posting. The updated or edited version supersedes any prior
versions immediately upon posting, and the prior version is of no continuing legal effect unless the
revised version specifically refers to the prior version and keeps the prior version or portions
thereof in effect. To the extent any amendment of this Agreement is deemed ineffective or invalid by any
court,the parties intend that the prior, effective version of this Agreement be considered valid and
enforceable
to the fullest extent.
12. Misuse of the license, if reported, shall involve instant disabling of license.
13. User has to use the software as per applicable laws of the land.
